Terms and conditions

Agreement

A legally binding agreement between you and Diving 2000 is established when you receive an order invoice via email. Until you receive an order invoice, Diving 2000 reserves the right to cancel your order in whole or in part, for example, due to pricing errors, typographical errors, or out-of-stock items. Should such a situation occur, you will be duly informed.

Return Policy for Customers within the EU

You have the right to cancel your purchase within 30 days from the day you receive the item(s). To exercise your right of withdrawal, you must notify us within 30 days via email, phone, or similar methods. Your notice must clearly indicate that you wish to exercise your right of withdrawal. You cannot cancel by simply refusing to accept the item without notifying us.

The item(s) must be returned without undue delay and no later than 30 days after you have notified us of your decision to withdraw from the purchase. You will bear the direct costs of returning the item(s). You are responsible for the risk of the item(s) from the time of delivery until they are returned to us, and you must ensure that the item(s) are securely packaged.

The right of withdrawal does not apply to custom-made products, such as Santi drysuits.

Return Policy for Customers Outside the EU

For customers located outside the European Union, please note the following conditions regarding returns:

Return Rights: Customers outside the EU do not automatically have the same return rights as those within the EU. Specifically, the 14-day return period mandated by EU regulations does not apply. However, if you wish to make a return, we encourage you to contact us as soon as possible so we can work together to find a suitable solution.

Local Laws: We will comply with the consumer protection laws of the country where the customer resides. This means that any return rights provided under local law will be honored.

Return Requests: If you wish to return an item, please reach out to our customer service team within the timeframe specified by your local laws. Our team will guide you through the return process in accordance with those laws, ensuring we find the best possible outcome for both parties.

Terms and Conditions: Any returns must comply with the specific terms and conditions outlined in this section and any additional instructions provided by our customer service team.

Shipping and Costs: Please be aware that return shipping costs, customs duties, and any other fees associated with the return may be the responsibility of the customer unless otherwise required by local law.

International Returns: Returns from outside the EU may take longer to process due to international shipping and customs procedures. We appreciate your understanding and patience as we work to resolve your return efficiently.

By placing an order with us, you acknowledge and agree to these terms regarding returns for customers outside the EU.

Condition of the Item When Returning

You are only liable for any diminished value of the item(s) resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the item(s). You may try the item(s) as you would in a physical store. If the item(s) have been used beyond what is described above, we consider them used, and this means that upon withdrawal, you will only receive a portion or none of the purchase amount, depending on the item's commercial value. To receive the full purchase amount, you must handle the item(s) as you would in a physical store.

Once the item(s) are returned and approved, the purchase price will be refunded to your account within a few days. You will bear the cost of returning the item(s).

Exceptions to the Right of Withdrawal

Special conditions apply when purchasing courses and activities.

The right of withdrawal does not apply to the purchase of diving trips or courses.

The right of withdrawal does not apply to products custom-made for the customer, including drysuits and wetsuits made to measure or custom lengths of ropes and similar items.

If a product is specially modified for the customer, the right of withdrawal does not apply; however, the right to complain still applies.

Recreational Activities, Sports Events, etc.

If the agreement specifies when (which day or specific period) the agreed event will take place, such as diving courses, the right of withdrawal does not apply.

Warranty

Diving 2000 offers a 2-year warranty in accordance with the Purchase Act, covering manufacturing and material defects found under normal use of the product, for customers within the EU. This warranty does not cover errors, damages, or wear and tear directly or indirectly caused by improper operation, poor maintenance, force, or unauthorized interventions.

Items should also be returned to this address. Note that we do not accept packages sent C.O.D. Returns can also be made by delivering the item(s) in person. It is not a requirement, but the process will be expedited if comprehensive information accompanies the package – for example, a copy of the order confirmation, as well as any prior correspondence.

Shipping and VAT

All orders shipped within the EU include VAT. VAT will be removed from your order during the checkout process if you select a country outside of the EU. Please note that your order may still be subject to local VAT or customs clearance fees upon arrival in your country.

Refunds

In case of agreed discounts, returned items, or pre-paid items that are canceled before shipping, a full or partial refund of the purchase amount will be made. Refunds are made to the same account as the purchase was made with.

Personal Information

No personal information registered with Diving 2000 A/S is transferred, sold, or made available to third parties at any time. All information is securely stored and is only accessible to trusted employees at Diving 2000 A/S.

For electronic payments, a secure, encrypted method through the Webshop system is used. It is an approved provider with approval from the Danish e-mark.

The Webshop system uses cookies to manage the contents of the shopping cart. A cookie is a file saved on your own PC. It is also possible to ask the system to save your address details for your next visit. If you wish to delete this information later, this can be done via your browser settings. In Internet Explorer, for example, this can be done via the "Tools" menu and the "Internet Options" submenu.

During a purchase, we ask for your name, address, phone number, and email address. This information is used solely to process your order. The information is transmitted and stored electronically in an unencrypted form and is kept for 5 years. The actual "contract" (purchase agreement) is not stored in a way that you can later log in and view/change status.

We also register the IP address from which any purchases are made. This information is normally not used but may be used in any police investigation. All false orders are reported to the police.

You can optionally have your email address added to a mailing list at Diving 2000 A/S to receive news and other information from Diving 2000 A/S. This service can be subscribed to and unsubscribed from as desired.

In accordance with the Danish Personal Data Act, we disclose registered information upon request, and we delete data as requested.

Diving 2000 A/S is the data controller. The director and sales staff of Diving 2000 A/S have access to the information registered about you.

Registration of IP Address

Your visit to Diving 2000 A/S is registered in a log file. The log files are used only for statistical purposes and provide a statistical picture of the number of visitors, their country of origin, etc.

Diving 2000 A/S uses log statistics to optimize the website and its functionalities to increase the site's user-friendliness.
